				<content:encoded><![CDATA[<p>When an Illinois driver is arrested for a DUI, the arresting officer will prepare a “Law Enforcement Sworn Report,” and the offender is given a copy of a document entitled “Notice of Summary Suspension.”  This document gives the offender notice that 46 days after receipt of the Notice, the Illinois Secretary of State will suspend the offender’s driver’s license and will also put the offender notice of what type of suspension it will issue.  The suspensions can range anywhere from three months to three years depending on the circumstances surrounding the particular case.<br />
The offender can challenge the suspension by requesting a judicial hearing.  Please note that this hearing will not stop the suspension from taking place.  It is important to understand the chronology of a DUI in Illinois with respect to the summary suspension.  Below is an outline for your reference.  </p>
<p><strong>Chronology of a DUI in Illinois  </strong></p>
<p>•	An officer will usually stop a vehicle at a roadside safety check or for probable cause, i.e. reasonable suspicion.<br />
•	The officer will likely request the driver’s license, proof of insurance and registration.<br />
•	If the officer suspects the driver is under the influence, the driver is asked to submit to field sobriety tests.<br />
•	If the officer has probable cause based on the field sobriety tests, the driver is placed under arrest for a DUI and taken to the police station.<br />
•	If the driver’s BAC is more than /05 but less than /08 and no drugs are found in the system, no statutory summary suspension will apply; however, the associated DUI charge will remain until appropriate action is taken by the court.<br />
•	If the driver’s tests show a BAC of .08 or more, or any trace of a drug, illegal substance or intoxicating compound, the driver will be issued a law enforcement sworn report notifying the driver of a statutory summary suspension.<br />
•	If the driver refuses to submit to or fails to complete testing, the statutory summary suspension will apply.<br />
•	If the driver’s license is valid, a receipt is issued allowing driving for up to 45 days.  </p>
<p>A statutory summary suspension occurs when a motorist either submits to a chemical testing that produces a result prohibited under Illinois law, or refuses to do so following a DUI arrest.
